Summary and Declaration
AVITA Medical, Inc. and its affiliates, including but not limited to AVITA Medical Americas, LLC (collectively, “AVITA Medical”) is committed to complying with all applicable laws, regulations, and industry standards. AVITA Medical has developed a comprehensive compliance program in accordance with the Compliance Program Guidance for Pharmaceutical Manufacturers developed by the U.S. Department of Health and Human Services Office of the Inspector General (the “OIG Guidance”) and California Health and Safety Code §§11940 – 119402, including policies consistent with AdvaMed’s Code Of Ethics On Interactions With Healthcare Professionals (“AdvaMed Code”). AVITA Medical holds its representatives and vendors to the same standards of applicable laws and regulations.
AVITA Medical’s written policies govern activities involving communicating with healthcare professionals about the appropriate use of our products including instruction, education, and training required for the safe and effective use of our products. AVITA Medical also has policies governing activities involving the advancement of scientific and educational activities supporting research and education. Every AVITA Medical employee must understand and comply with these obligations.
California Spend Limit
AVITA Medical’s relationships with healthcare professionals are intended to benefit patients and to enhance the practice of medicine. Informational presentations and discussions by AVITA Medical representatives and others speaking on behalf of AVITA Medical provide valuable scientific and educational benefits. In connection with such presentations or discussions, AVITA Medical may offer occasional meals and healthcare practice-related items in accordance with the AdvaMed Code.
Pursuance to the requirements of California Health & Safety Code §§119400-119402, AVITA Medical has established a specific annual aggregate limit of $2,000 for meals and educational items that may be provided to California healthcare professionals.
In accordance with California law, certain items and payments are excluded in determining whether the annual limit has been met. The annual spending limit does not include the value of:
- Drug samples provided to individual healthcare professionals;
- Financial support of independent education, including continuing medical education programs and the value of travel expenses for attendance;
- Financial support for health education scholarships; and
- Payments for legitimate professional services, including professional speaking, advising, consulting, product training or market research services, that are based on the fair market value of the services provided.
Annual Declaration for Purposes of Health & Safety Code, §§ 119400-119402
To the best of our knowledge, as of the date of this declaration, AVITA Medical’s comprehensive compliance program addresses the California statutory requirements for inclusion of policies addressing the OIG Guidance and AdvaMed Code and limits on gifts and incentives to healthcare professionals. Subject to the above, AVITA Medical declares that it is, in all material respects, in compliance with California Health & Safety Code §§ 119400-119402.

Right to not share. AVITA Medical may not share a consumer’s personal information upon the consumer’s request.
Right to Opt-out. AVITA Medical does not sell Personal Information to third parties. However, should it ever do so, California consumers have the right, at any time, to opt out of such sale or disclosure of their sensitive Personal Information, as defined in law, used or disclosed for advertising or marketing. In addition, AVITA Medical must obtain permission before collecting data from consumers who are younger than 16; and must obtain permission from a parent or guardian before collecting data from consumers who are younger than 13.
Right to Non-Discrimination. If you exercise your privacy rights, we will not discriminate against you, for example, by charging you different prices for the same products or denying you access to our services.
We will make every reasonable effort to fulfill your request, but in some instances may deny the request if the information meets certain exceptions as defined in the CCPA.
Submitting a Request or Inquiry
If you are a California resident and you want to submit a request or inquiry to us regarding your California rights, you or your authorized agent can contact us at compliance@avitamedical.com. An “authorized agent” is a third-party you have designated to perform your request for you. Before helping you or your agent, we may ask to verify your identify or the identify of your authorized agent.
We will disclose and deliver the required information to you free of charge within 45 days or receiving a verifiable request. If we need more than 45 days, we will notify you that your request is being delayed.

Non-Retaliation Policy

Compliance Program
AVITA Medical’s Compliance Program is designed around the U.S. Department of Health and Human Services Office of Inspector General’s Seven Elements of an Effective Compliance Program. The General Counsel & Chief Compliance Officer leads the Compliance Program, while the day-to-day operations of the Compliance Program is delegated to the Head of Compliance & Legal Counsel.
Interactions with Health Care Professionals and Government Agencies
AVITA Medical seeks to work effectively and ethically in all our interactions with physicians and other health care professionals. In doing so, we adhere to the AdvaMed Code of Ethics and have incorporated its provisions into the Compliance Program.
AVITA Medical also complies with all Federal and State reporting requirements, including requirements concerning payments or transfers of value to certain health care professionals.
Patient Privacy and HIPAA
While AVITA Medical is not a HIPAA Covered Entity, the Company ensures the privacy of information that we may receive, consistent with applicable law and regulations.
